Terms & Conditions, Lokab Systems AB

These Terms and Conditions are applicable in cases where Swedish or other applicable law does not prescribe conditions that conflict with the same. The terms of purchase apply to both companies and consumers.
Lokab Systems AB is called Lokab in the Terms and Conditions.

You can order via our website, by phone and email, and thus you have accepted our Terms and Conditions and Privacy Policy.

Order business customer
The person who acts as a represent of a company shall have, and hereby warrant that she/he has, the authority to enter into an agreement and make a purchase for the company it represents.

Order private customer
Clients under the age of 18 must get parents permission before the purchase is made. Orders made in the name of another person without her/his permission or otherwise causing Lokab to suffer financial damage will be reported to the police.

Payment and prices
Packaging, shipping* and VAT are added at all prices. Orders will be VAT exempt with reference to 3 chap. 30 a § ML. Payment terms invoice 30 days net or advance payment. Lokab reserves the right to alter any price changes, incorrect prices and final sales. In cases where the price of a product is clearly incorrect, this may force Lokab to cancel the purchase and refund any paid money in the best way. This can be done at any time during the course of the transaction when the error is detected. The reason for the error must be clearly reported to the customer in connection with the cancellation of the purchase.

Base freight within sweden is from 115 SEK (excl. VAT) per order. Shipped with DB Schenker.

Delivery terms and conditions of delivery
Lokab uses General Delivery Terms NL01 and Incotems EXW and DAP.

Delivery times and cancellation
In case the customer considers that delivery is delayed in such a way that it no longer wishes for delivery of order, it is the customer's responsibility to cancel the order in accordance with Lokab's Terms and Conditions. Cancellation after the order has been expedited is not possible. In cases where orders have been expedited, the customer is obliged to receive the shipment. Cancellation of non-stocked product, which is purchased specifically for the customer, is not possible. Cancellation is not valid until the customer has received confirmation from Lokab either by mail or by fax.

Delivery control
Customer shall check all goods in order to verify that the number and products on the delivery slip are in accordance with the delivery. Remarks against this should be made within 7 days.

Right of ownership
All goods remain the property of Lokab until full payment is made.

Liability for defects
Our liability arising from defects in the product is limited to these terms of sale. Lokab carries no direct or indirect liability for, for example (but not limited to) incompatibility, delivery delays, interruptions, data loss, additional work or other financial damage. We reserve the right for any printing errors, errors in information or specification, on all products and services in the Lokab range. All image information should be seen as illustrations, and can not be guaranteed to reflect the exact appearance and nature of the product.

All items in our range are subject to a minimum of one year warranty, unless otherwise stated, except for consumables. In cases where the manufacturer provides a longer warranty period than one year, the product is subject to the same but warranty claims shall be lodged with this manufacturer after the first year of expiry. In some cases, warranty claims will be retained by the manufacturer already in year one. Lokab leaves no further warranties beyond that specified by the manufacturer.

To make a complaint, the customer must contact Lokab, stating the order and invoice number and the reason for the complaint. Defective products to be returned to Lokab should be treated as if they were intact. For all types of returns it is extremely important that the product is packaged in such a way that it is not at risk of injury. Customer pays for shipping to Lokab. In cases where the return is a guarantee or a complaint, but errors can not be detected, a fee of 250 SEK + shipping excl. VAT will be charged. This is to cover Lokab's costs of handling the case. Lokab reserves the right to replace defective goods with equivalent, in cases where identical are not available.

A delivery that has not been retrieved
For delivery that is not been retrieved and the package is returned to Lokab, the shipping costs and an administration fee of 250: - plus VAT will be charged.

Damaged goods
If a product from Lokab is damaged during transportation, regardless of whether the damage is clearly visible or hidden, this must be reported to the transport company immediately.

Force majeure
In the event of war, natural disaster, industrial action on the labour market, public authority decision, failure of a supplier to provide deliveries, circumstances that increase costs and comparable events outside our control which could not reasonably have been foreseen and which affect contractual agreements and commitments made by Lokab and which prevent Lokab from adhering to such agreements, this shall constitute grounds for Lokab to be released from its obligations to fulfil said agreements.

Privacy Policy
Lokab handles personal information confidentially and handles the information provided in accordance with the General Data Protection Regulation (GDPR).
We never sell your personal information to third parties. But in order to fulfill our commitment to you as a customer and / or supplier, we only share your personal information regarding companies that help us, such as shipping and logistics companies, bank and credit card companies.
Lokab Systems may have to disclose your personal information if required by applicable laws or regulations, or to respond to a request from a legal or administrative authority.

Lokab reserves the right to change all information, including but not limited to prices, technical specifications and product offerings without prior notice. In case a product is sold out the mentioned price picture or no longer are in stock, Lokab has the right to cancel the purchase and repay any paid money in the best possible way. Lokab will also inform the customer if replacement or equivalent product is available.
